NOTICE
Pursuant to Ordinance 04-01, as amended, and the Colorado River Indian Tribes Business and Professions Code Article I, the Colorado River Indian Tribes Department of Revenue and Finance hereby provides notice to all business owners operating within lands subject to the jurisdiction of the Colorado River Indian Tribes of the tribal business license requirement. All persons conducting or engaged in business or trade upon lands subject to the jurisdiction of the Colorado River Indian Tribes must obtain a tribal business license and pay a license fee prior to engaging in any such business or trade. This includes lands within the exterior boundaries of the Colorado River Indian Reservation in the States of Arizona and California, including Big River, California and tribal lands in the Town of Parker, Arizona. “Business” is defined as “all activities or acts, personal, corporate or otherwise, engaged in with the object of profit, gain, benefit or advantage, either directly or indirectly, wholly or in part, within lands subject to the jurisdiction of the Tribes.” This includes any business, whether located on of off tribal land, that delivers any goods or services to the Tribes, tribal members or tribal land. Any businesses that have conducted business or trade on tribal lands in 2005 and who have failed to obtain a 2005 Tribal Business License must do so by December 31, 2005 to avoid enforcement action by the Department. Notices and applications for renewal for a 2006 Tribal Business License have been mailed to current license holders and should be returned to the Department with the appropriate payment by January 1, 2006. In addition to any other remedies the Tribes may have, any person who conducts business or trade without a tribal business license or fails to comply with the Colorado River Indian Tribes' Business and Professions Code may be subject to civil fines and penalties as provided in the Tribes' Business and Professions Code Section 1-113, which states in pertinent part:
“Conducting business within lands subject to the jurisdiction of the Tribes in the absence of a tribal business license or the failure by any licensee to comply with the requirements of this Article or other tribal laws shall subject the person to any of the following: (a) forfeiture of license; (b) forfeiture to the Tribes of all improvements constructed on, or any personal and real property found upon, tribally owned lands; (c) expulsion from the Reservation; and (d) civil fines as provided herein.
